1. 서비스 개요

뮤직컷(MusiqCut, 이하 "앱" 또는 "서비스")은 musiqcut.com에서 운영되는 AI 기반 숏폼 뮤직비디오 자동 생성 앱입니다. 테마/분위기를 입력하면 AI가 가사, 음악, 애니메이션 영상, 자막을 자동으로 제작하며, 완성된 영상을 소셜 미디어 플랫폼에 업로드할 수 있습니다. 본 앱은 개인 프로젝트로 운영됩니다.

2. 이용 자격 및 접근

• 본 서비스는 Cloudflare Access를 통해 인증된 사용자만 이용할 수 있습니다.
• 접근 권한은 서비스 관리자가 부여하며, 사전 통보 없이 변경될 수 있습니다.
• 만 14세 미만은 서비스를 이용할 수 없습니다.

3. AI 생성 콘텐츠

• 본 서비스는 다수의 AI 모델을 활용하여 콘텐츠를 생성합니다.
• AI 생성 콘텐츠의 저작권 및 이용 권한은 관련 AI 서비스 제공자의 이용약관을 따릅니다.
• 생성된 콘텐츠에 실존 인물, 브랜드, 저작물이 의도치 않게 포함될 수 있으며, 이에 대한 확인 및 책임은 업로드하는 사용자에게 있습니다.
• AI가 생성한 콘텐츠는 정확성, 적절성, 완전성을 보장하지 않습니다.
• 서비스를 통해 생성된 영상에는 C2PA/IPTC 표준에 따른 AI 생성 메타데이터가 자동으로 삽입됩니다.

4. 소셜 미디어 연동 및 업로드

• YouTube, Instagram, TikTok 계정 연동 시 해당 플랫폼에 영상을 업로드하는 용도로만 사용됩니다.
• 연동은 설정 페이지에서 언제든지 해제할 수 있으며, 해제 시 저장된 인증 정보는 즉시 삭제됩니다.
• 업로드된 콘텐츠에 대한 관리 및 책임은 해당 플랫폼 계정 소유자에게 있습니다.
• 각 플랫폼의 API 할당량, 정책 변경, 서비스 장애로 인해 업로드가 실패할 수 있습니다.

5. 사용자의 의무

• API 키는 사용자 본인의 것을 사용해야 하며, 타인의 키를 무단 사용해서는 안 됩니다.
• 생성된 콘텐츠를 불법적인 목적, 타인의 명예 훼손, 혐오/차별 조장 등에 사용해서는 안 됩니다.
• 플랫폼 업로드 시 각 플랫폼의 커뮤니티 가이드라인 및 저작권 정책을 준수해야 합니다.
• AI 생성 콘텐츠임을 적절히 표시해야 하며, 각 플랫폼이 요구하는 AI 레이블 정책을 따라야 합니다.
• 서비스의 보안을 우회하거나 시스템에 과도한 부하를 가하는 행위를 해서는 안 됩니다.

6. 지적 재산권

• 서비스의 소프트웨어, 디자인, 로고, 상표는 서비스 운영자에게 귀속됩니다.
• AI 생성 콘텐츠의 지적 재산권은 관련 법률 및 각 AI 서비스 제공자의 약관에 따릅니다.
• 사용자가 입력한 테마, 분위기 등의 창작적 기여에 대한 권리는 사용자에게 있습니다.

7. 서비스의 변경 및 중단

• 서비스의 기능, 디자인, 사용 AI 모델 등은 사전 통보 없이 변경될 수 있습니다.
• 서비스는 기술적 문제, 유지보수, 외부 서비스 장애 등의 이유로 일시적으로 중단될 수 있습니다.
• 서비스는 사전 통보 후 영구적으로 종료될 수 있으며, 종료 시 합리적인 기간 내에 데이터 다운로드 기회를 제공합니다.

8. 면책 조항

• 본 서비스는 "있는 그대로(AS IS)" 제공되며, 특정 목적에의 적합성, 정확성, 신뢰성에 대한 보증을 하지 않습니다.
• 서비스 중단, 데이터 손실, AI 생성 결과물의 품질이나 적절성에 대해 보증하지 않습니다.
• 외부 서비스(Google, Meta, TikTok, Cloudflare 등)의 장애, 정책 변경, API 할당량 초과로 인한 서비스 제한에 대해 책임지지 않습니다.
• 업로드된 콘텐츠로 인한 플랫폼 정책 위반, 저작권 침해, 법적 분쟁에 대한 책임은 사용자에게 있습니다.

9. 손해 배상의 제한

서비스 이용으로 인한 직접적, 간접적, 부수적, 특별한 손해에 대해 서비스 운영자는 법률이 허용하는 최대 범위 내에서 책임을 지지 않습니다.

10. 약관의 변경

본 약관이 변경되는 경우 시행일 최소 7일 전에 서비스 내 공지를 통해 안내합니다. 변경된 약관에 동의하지 않는 경우 서비스 이용을 중단할 수 있습니다.

11. 준거법 및 분쟁 해결

본 약관은 대한민국 법률에 따라 해석되며, 서비스 이용과 관련한 분쟁은 대한민국 법원을 관할 법원으로 합니다.

1. Service Overview

MusiqCut (the "App" or "Service") is an AI-powered short-form music video generation app operated at musiqcut.com. Users input a theme or mood, and the MusiqCut app automatically creates lyrics, music, animated visuals, and subtitles. Completed videos can be uploaded to social media platforms. This app is operated as a personal project.

2. Eligibility and Access

• Access to this service requires authentication through Cloudflare Access.
• Access permissions are granted by the service administrator and may be changed without prior notice.
• Users must be at least 14 years of age to use this service.

3. AI-Generated Content

• This service utilizes multiple AI models to generate content.
• Copyright and usage rights of AI-generated content are subject to the terms and conditions of the respective AI service providers.
• Generated content may unintentionally include real persons, brands, or copyrighted material. Users are responsible for reviewing content before uploading.
• AI-generated content is not guaranteed for accuracy, appropriateness, or completeness.
• Videos generated through this service automatically include AI-generation metadata following C2PA/IPTC standards.

4. Social Media Integration and Uploads

• YouTube, Instagram, and TikTok account connections are used solely for uploading videos to those platforms.
• Connections can be removed at any time from the settings page; stored authentication data is immediately deleted upon disconnection.
• Users are responsible for managing and maintaining uploaded content on their respective platform accounts.
• Uploads may fail due to platform API rate limits, policy changes, or service outages.

5. User Responsibilities

• Users must use their own API keys and must not use another person's keys without authorization.
• Generated content must not be used for illegal purposes, defamation, or promoting hate/discrimination.
• Users must comply with each platform's community guidelines and copyright policies when uploading.
• Users must properly disclose AI-generated content and follow each platform's AI labeling requirements.
• Users must not attempt to circumvent service security or place excessive load on the system.

6. Intellectual Property

• The service's software, design, logos, and trademarks belong to the service operator.
• Intellectual property rights of AI-generated content are subject to applicable laws and the terms of each AI service provider.
• Users retain rights to their creative contributions such as themes, moods, and other inputs.

7. Service Modifications and Termination

• Service features, design, and AI models used may change without prior notice.
• The service may be temporarily suspended due to technical issues, maintenance, or external service outages.
• The service may be permanently terminated with prior notice, providing a reasonable period for data download.

8. Disclaimer of Warranties

• This service is provided "AS IS" without warranties of any kind, including fitness for a particular purpose, accuracy, or reliability.
• We do not guarantee uninterrupted service, data preservation, or the quality/appropriateness of AI-generated content.
• We are not responsible for service limitations caused by third-party service outages, policy changes, or API quota exhaustion (Google, Meta, TikTok, Cloudflare, etc.).
• Users are responsible for any platform policy violations, copyright infringement, or legal disputes arising from uploaded content.

9. Limitation of Liability

To the maximum extent permitted by law, the service operator shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of this service.

10. Changes to These Terms

If these terms are updated, we will provide notice through the service at least 7 days before the effective date. If you do not agree to the updated terms, you may discontinue use of the service.

11. Governing Law and Disputes

These terms are governed by the laws of the Republic of Korea. Any disputes related to the use of this service shall be subject to the jurisdiction of the courts of the Republic of Korea.
